Republic Act No. 11285 ( Energy Efficiency and Conservation Act)

Also known as the Energy Efficiency and Conservation Act, was enacted in the Philippines to institutionalize energy efficiency and conservation measures across the country. It promotes efficient energy use, enhances energy security, and helps reduce greenhouse gas emissions.

Key Objectives:

Major Provisions:

    • All government agencies and designated establishments (private sector) must develop an Energy Efficiency and Conservation Plan (EECP) detailing how they will reduce their energy consumption.
  2. Designated Establishments:

    • The law classifies businesses into Designated Establishments (DEs) based on energy consumption levels. DEs are required to comply with specific guidelines, including regular reporting of energy consumption and the appointment of energy officers.
  3. Appointment of Energy Managers:

    • Large consumers of energy (such as industrial and commercial establishments) must appoint a certified Energy Conservation Officer and/or Energy Manager to implement and monitor energy conservation measures within the organization.
  4. Mandatory Energy Audits:

    • All designated establishments must undergo regular energy audits to assess their energy consumption and identify areas for improvement. The audits are conducted by certified energy service companies (ESCOs) or accredited professionals.
  5. Incentives for Energy Efficiency Projects:

    • Tax incentives are provided for projects that lead to energy conservation. For example, businesses investing in energy-efficient machinery, equipment, or technologies may receive tax deductions and exemptions.
  6. Promotion of Energy Efficiency Technologies:

    • The government promotes the use of energy-efficient technologies and products by setting minimum energy performance standards (MEPS) for appliances and equipment.
  7. Public Awareness and Education:

    • The law encourages the promotion of energy efficiency and conservation through public awareness campaigns, educational programs, and professional training to develop expertise in energy management.

Penalties for Non-Compliance:

Organizations that fail to comply with the provisions of R.A. 11285 may face various penalties:

  • Fines ranging from ₱10,000 to ₱1,000,000, depending on the severity of non-compliance.
  • Suspension or cancellation of business permits.
  • Public warnings and possible inclusion on a non-compliant business list.
